These Terms of Service govern your use of Nypko. By using the service you agree to these Terms.
1. The service
Nypko provides a free, browser-based tool that converts user-uploaded photos into printable fuse bead patterns. Nypko is a personal project operated by an individual, not a company. All image processing happens client-side. The service is provided “as is”, without warranty of any kind.
2. Eligibility
You must be at least 13 years old (or the age of digital consent in your the operator’s country of residence, whichever is higher) to use Nypko. If you are using Nypko on behalf of someone else (e.g. a student, a client), you represent that you have authority to accept these Terms on their behalf.
3. Acceptable use
You agree not to use Nypko to (a) generate patterns from images you do not have the right to use (including copyrighted images of third parties without permission); (b) attempt to disrupt the service, including via denial-of-service attacks or automated scraping beyond reasonable personal use; (c) violate any applicable law.
4. Intellectual property
The Nypko brand, logos, design system, and source code are owned by Nypko. The patterns and color charts you generate are yours to keep and to print for personal or commercial use. We do not claim ownership over your uploaded photos.
5. Third-party links
Nypko links to third-party websites, primarily Amazon, as part of our shopping-list feature. We are not responsible for the content or practices of those websites. Clicking those links takes you to a third party; their terms and privacy policies apply.
6. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” NYPKO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. NYPKO DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
7. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NYPKO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES. NYPKO’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED ONE HUNDRED US DOLLARS (US100).
8. Indemnification
You agree to indemnify and hold Nypko harmless from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of your use of the service in violation of these Terms or applicable law.
9. Termination
We may suspend or terminate access to the service at any time, with or without cause, with or without notice. Provisions that by their nature should survive termination — including ownership, disclaimers, indemnity, and limitations of liability — survive.
10. Governing law and dispute resolution
These Terms are governed by the laws of the operator’s country of residence, without regard to its conflict-of-laws principles. Because Nypko is operated by an individual (the operator of Nypko) rather than a registered company, any dispute will be resolved in the courts of that the operator’s country of residence. You consent to the personal the operator’s country of residence of those courts.
11. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date above will reflect the most recent change. Material changes will be announced on the homepage. Your continued use of the service after a change constitutes acceptance of the updated Terms.
